Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and SELCOR, INC dba Receptive ("Receptive," "we," "us," or "our") governing your access to and use of our AI phone agent platform, websites, and related services (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Receptive provides software that lets you deploy AI phone agents that answer calls, book appointments, follow up, and connect to the software a business already uses. Features, plans, and limits may change over time.
2. Accounts and eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for your account, for keeping your credentials secure, and for all activity under your account and the workspaces you manage.
3. Subscriptions, billing, and usage
- The Service is offered on fixed monthly plans billed at the account level across the workspaces you run.
- Plans include a monthly allowance of call minutes; usage beyond the allowance is billed as overage at the per-minute rate shown at checkout.
- A set number of phone numbers is included with each plan; additional numbers are billed as a recurring monthly add-on.
- AI builder usage is subject to fair-use limits described on our pricing page.
- Fees are billed in advance, are non-refundable except where required by law, and are exclusive of taxes. We may change pricing on a prospective basis with notice.
4. Acceptable use
You agree not to use the Service to:
- Violate any law or regulation, including telemarketing, robocall, call-recording, and consumer-protection laws such as the TCPA and applicable state laws;
- Place or facilitate unlawful, deceptive, harassing, or unsolicited calls;
- Infringe intellectual property or privacy rights, or transmit unlawful or harmful content;
- Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service; or
- Resell or misrepresent the Service.
5. Your responsibilities
You are responsible for the content, prompts, knowledge bases, and call flows you configure, and for the outcomes of calls handled on your behalf. You are solely responsible for providing all notices and obtaining all consents required to record, transcribe, and process calls in the jurisdictions where you and your callers are located, and for your compliance with all laws applicable to your use of the Service.
6. Third-party services
The Service integrates with third-party software and telephony providers. Your use of those services is governed by their own terms, and we are not responsible for third-party services.
7. Intellectual property
We and our licensors own the Service and all related intellectual property. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of the content and data you provide, and you grant us the rights necessary to operate and improve the Service.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated responses and transcriptions may be inaccurate or incomplete, and you should not rely on the Service for emergency communications.
9. Limitation of liability
To the maximum extent permitted by law, SELCOR, INC dba Receptive will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the twelve months before the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless SELCOR, INC dba Receptive from claims, damages, and expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
11. Termination
You may cancel at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that creates risk or legal exposure. Upon termination, your right to use the Service ends; certain provisions survive termination.
12. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute that may be brought in court will be the state and federal courts located in Lee County, Florida.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with an updated date, and your continued use of the Service after changes take effect constitutes acceptance.
